1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the AtlasPerk website at atlasperk.com and all associated services, including our market intelligence platform and consultancy offerings. By accessing or using our services, you confirm that you have read, understood, and agree to these Terms.

If you are using our services on behalf of a business, you confirm that you have authority to bind that business to these Terms.

2. Services Description

AtlasPerk provides two categories of service:

• Market Intelligence Platform — A library of destination and segment intelligence reports covering operator landscapes, competitive analysis, pricing benchmarks, and strategic insights for the travel and hospitality industry.
• Consultancy Services — Strategic advisory services including growth diagnostics, SEO and digital marketing strategy, website optimisation, and systems consultancy for travel businesses.

Service terms specific to consultancy engagements will be governed by a separate statement of work or service agreement provided at the time of engagement.

3. Use of the Website and Intelligence Content

You may access and read AtlasPerk's website and intelligence content for your own internal business purposes. You may not:

• Reproduce, redistribute, or republish our reports, frameworks, or analysis without written permission
• Scrape, copy, or extract content from our platform using automated tools
• Resell or sublicense access to our intelligence content to third parties
• Use our content in a way that misrepresents its source or origin
• Use our website or services for any unlawful purpose

4. Intellectual Property

All content on AtlasPerk — including intelligence reports, analysis frameworks, methodologies, written content, design elements, and data compilations — is the property of AtlasPerk and is protected by applicable intellectual property laws.

Our 32 analysis frameworks, Quality Grade Algorithm, Source Tier Reference system, and associated methodologies are proprietary to AtlasPerk. You may reference our findings for internal business purposes, but may not reproduce our frameworks or methodologies in commercial products or services.

Third-party data and statistics referenced in our reports are the property of their respective owners and are cited accordingly.

5. User Submissions

When you submit information through our Growth Diagnostic scorecard, contact forms, or other input mechanisms, you grant AtlasPerk permission to use that information to:

• Deliver the service you requested (e.g. your diagnostic report)
• Communicate with you in connection with that service
• Improve our understanding of the market we serve, in aggregate and anonymised form

6. Disclaimer

AtlasPerk's intelligence reports and consultancy outputs are provided for informational and strategic planning purposes only. They do not constitute financial advice, legal advice, investment advice, or any other form of regulated advisory service.

While we take care to ensure the accuracy of our analysis, market conditions change and we cannot guarantee that all information is current, complete, or applicable to your specific circumstances. You should conduct your own due diligence before making business decisions based on our content.

7. Limitation of Liability

To the fullest extent permitted by applicable law, AtlasPerk shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, intelligence content, or consultancy services — including but not limited to loss of revenue, loss of data, or business interruption.

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the amount you paid us in the 12 months preceding the claim, or €100 if no payment has been made.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the competent courts in Spain.

9. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Your continued use of our services after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
